There are three agencies responsible for regulating different aspects of Low Level Radioactive Waste (LLRW) disposal at the Texas LLRW disposal facility. The following is an attempt to clarify each agency's role, what regulations apply and whom to contact for more information or questions.
1. Texas Department of State Health Services, Radiation Control Program, Radiation Safety Licensing Branch
- Regulates shipping and transportation of LLRW to the Texas Disposal Facility under 25 Texas Administrative Code §289.252 "Licensing of Radioactive Material" and §289.257 "Packaging and Transportation of Radioactive Material".
2. Texas Commission on Environmental Quality (TCEQ)
3. Texas Low Level Radioactive Waste Disposal Compact Commission (TLLRWDCC)
- The TLLRWDCC is responsible for setting policies and rules providing for the efficient management of the Texas LLRW disposal facility under the Texas and Vermont waste disposal compact agreement. For more information, see http://www.tllrwdcc.org/index.html. The TLLRWDCC is independent and not a State agency
Applications process for Registration of Shippers of LLRW to the Texas LLRW Disposal Facility includes submission of:
A letter requesting to be registered including the business name, mailing address, contact person, phone number, e-mail and fax along with a business information [RC252-1] form that can be found at: www.dshs.texas.gov/radiation/forms.shtm,
- Emergency Plan for the response to an accident or incident involving shipments of radioactive waste.
- A list of approved shipping containers along with their certificates of compliance or other certifying documentation. For a shipper that manufactures their own containers they must submit their quality assurance procedures.
- There is no application fee. Shippers are charged $10 per cubic foot, and will be billed by the Department after the shipment is completed.
- Guidance for preparing the Emergency Plan and Quality Assurance procedures (if necessary) can be found in Regulatory Guide 2.19 “Guide for Submission of Documents and Fees by Low Level Radioactive Waste Shippers and Transporters.” Applicable statutes can be found at www.dshs.texas.gov/radiation/rules.shtm in Sections 289.252 and 257.

- Emergency Plan for the response to an accident or incident involving shipments of radioactive waste.
- Proof of financial responsibility such as insurance that the carrier has in order to comply with U.S. Department of Transportation requirements.
- There is no application fee, or fee based on the amount of material transported by a carrier.
- Guidance for preparing the Emergency Plan and submitting proof of financial responsibility can be found in Regulatory Guide 2.19 “Guide for Submission of Documents and Fees by Low Level Radioactive Waste Shippers and Transporters.” Applicable statutes can be found at www.dshs.texas.gov/radiation/rules.shtm in Sections 289.252, and 257.
