Specific Legislation Related to Family Planning Services

Freedom to Choose - (42 CFR 441.20 and 431.50)
These regulations stipulate that the state's plan for family planning services must ensure that individuals eligible for family planning services are free from coercion or mental pressure and are free to choose the method of family planning and the provider.

Sterilization - (42 CFR 441.250 Subpart F)
Federal regulation governs Medicaid's reimbursement for voluntary sterilization and specifies the federal requirements for informed consent of the individual to be sterilized.

Confidentiality - Federal rules (42 CFR 431 Subpart F) and the Texas Administrative Code (25 TAC Section 56.12) require that DSHS and provider ensure that information about family planning clients is safeguarded. Clients must give written permission for release of client information and confidentiality must be maintained.
