The information in this section is intended to provide public notice of disciplinary action by the Department of State Health Services and the Division for Regulatory Services, Enforcement Unit and is not intended to reflect the specific findings of either entity.

This information may not reflect any number of factors including, but not limited to, the severity of harm to a patient, any mitigating factors, or a provider/certificant's disciplinary history.  This listing is not intended as a guide to the level of sanctions appropriate for a particular act of misconduct.

April 26, 2015, 6 month probated suspension for violating EMS Rules 25 TAC §§157.36(b)(2),  157.36(b)(14), 157.36(b)(26), 157.36(b)(28), and 157.36(b)(30) related to receiving deferred adjudication for felony criminal offense of theft, and misappropriating equipment from a fire department.

Birden, Joel C., Kingwood, TX. June 6, 2015, revoked for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(21), 157.36(b)(22), 157.36(b)(23), 157.36(b)(26), 157.36(b)(27),   157.36(b)(28), and 157.36(b)(30) related to an arrest and deferred adjudication for burglary of habitation, failing to notify the Department of an arrest and change in criminal history, and failing to provide the Department with requested information.

Birhiray Holdings Inc. DBA Pulse EMS, Houston, TX. July 21, 2014, assessed a $1,350.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(m)(20) and 157.16(d)(19) related to failing to notify the Department of a change of its medical director.

Bonaventure C Mbonu & Andre Leevet Elder DBA Alpha Medics EMS, Houston, TX. November 17, 2014, assessed a $500.00 administrative penalty for violating EMS Rule 25 TAC §157.16(d)(12) related to failing to give the Department information requested.

Brogdon, Tristan O., Mansfield, TX. February 3, 2015, 24 months probated suspension for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(6), 157.36(b)(22), 157.36(b)(23), 157.36(b)(26), 157.36(b)(28), and 157.36(b)(30) related to arrests for assault family violence impede breathing/circulation, aggravated assault with a deadly weapon, injury to a child, receiving deferred adjudications for a 3rd degree felony criminal offense of assault family violence impede breathing/circulation, a 2nd degree felony criminal offense of aggravated assault with a deadly weapon, a state jail felony criminal offense of injury to a child, conviction for a class A misdemeanor criminal offense of assault bodily injury – family member, failing to notify the Department about arrests, and failing to notify the Department of a change in criminal history.

Buckhannan, Jennifer, Barry, TX. June 27, 2015, 6 month probated suspension for violating EMS Rules 25 TAC §§157.36(b)(3), 157.36(b)(7), 157.36(b)(9),  157.36(b)(28),  and 157.36(b)(30) related to failing to properly assess and transport a patient and failing to make accurate and complete PCR.

Calhoun County EMS, Port Lavaca, TX. October 1, 2014, reprimanded for violating EMS Rules 25 TAC §§157.11(m)(1), 157.11(m)(4), 157.16(d)(14), and HSC §773.050(a) related to staffing an EMS ambulance vehicle with EMS personnel with expired certifications.

City of Nassau Bay EMS, Nassau Bay, TX. April 26, 2015, assessed a $2,600.00 administrative penalty for violating EMS Rules 25 TAC §§ 157.11(m)(1), 157.11(m)(4), 157.16(d)(14) and HSC §773.050(a) related to staffing an EMS ambulance vehicle with a person that had an expired DSHS issued license and/or certificate.

City of Sachse Fire Department, Sachse, TX. October 30, 2014, assessed a $700.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(m)(1), 157.11(m)(4), 157.16(d)(14), and HSC §773.050(a) related to staffing an EMS ambulance vehicle with EMS personnel with expired certifications.

Clark, Christopher A., New Waverly, TX. October 1, 2014, revoked for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(21), 157.36(b)(22), 157.36(b)(23), 157.36(b)(26), 157.36(b)(27), and 157.36(b)(30) related to an arrest for improper photography or visual recording, failing to notify the Department of an arrest, conviction of a Class A Misdemeanor criminal offense of attempted improper photography, failing to notify the Department of a change in criminal history, failing to give the Department information requested.

Clarke, Joshua, North Richland Hills, TX. September 29, 2014, revoked for violating EMS Rules 25 TAC §§157.36(b)(17) and 157.36(b)(21) related to failing to respond to the Department request for information and photographing a past course exam and then electronically distributing to students.

Coleman County Medical Center DBA Coleman County EMS, Coleman, TX. October 30, 2014, assessed a $3,600.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(m)(1), 157.11(m)(4), 157.16(d)(14), and HSC §773.050(a) related to staffing an EMS ambulance vehicle with EMS personnel with expired certifications.

Cooke County EMS, Gainesville, TX. September 24, 2014, assessed a $700.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(m)(1), 157.11(m)(4), 157.16(d)(14), and HSC §773.050(a) related to staffing an EMS ambulance vehicle with EMS personnel with expired certifications.

Coppell Fire Department, Coppell, TX. September 24, 2014, assessed a $1,750.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(m)(1), 157.11(m)(4), 157.16(d)(14) and HSC §773.050(a) related to staffing an EMS ambulance vehicle with EMS personnel with expired certifications.

Deer Park Volunteer Fire Department, Deer Park, TX. January 3, 2015, reprimanded for violating EMS Rules 25 TAC §§157.11(m)(3) and 157.16(c) related to failing to monitor the quality of patient care provided.

Delancey, Deavon, Horseshoe Bay, TX. February 27, 2015, revoked for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(6), 157.36(b)(21), 157.36(b)(23), 157.36(b)(25), 157.36(b)(28), and 157.36(b)(30) related to an arrest for a felony offense of sexual assault of a child, an arrest for a felony offense of possession of child pornography, failing to notify the Department about arrests, and failing to respond to Department request for information.

Devine Solutions Group LLC DBA Quick Response EMS, Stafford, TX. October 16, 2014, assessed a $3,750.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(c)(2)(D), 157.11(d)(1), 157.11(I)(2), 157.11(i)(3),  and 157.11(j)(5) related to failing to have EMS ambulance vehicle(s) adequately equipped and supplied at all times, failing to assure critical patient care equipment has spare batteries or an alternative power source, maintain and have in date all solutions and pharmaceuticals in accordance with FDA recommendations, and failing to display vehicle authorization in patient compartment.

Dingfield, Heather, Coppell, TX. February 25, 2015, reprimanded for violating EMS Rules 25 TAC §§157.36(b)(1), 157.36(b)(30), and HSC §773.041(b) related to staffing an EMS ambulance vehicle with an expired DSHS-issued license and/or certification.

DiVincenzo, Daniel J., Joshua, TX. June 27, 2015, 30 day suspension for violating EMS Rules 25 TAC §§157.36(b)(7), 157.36(b)(14), 157.36(b)(28) and 157.36(b)(30) related to allowing your partner to start an IV on you for demonstration purposes at a child care center without authorization from MD and misappropriating supplies and equipment from your employer. 

Earthman, David, Austin, TX. August 12, 2014, reprimanded for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(19), 157.36(b)(23), 157.36(b)(26), 157.36(b)(28), and 157.36(b)(30) related to receiving deferred adjudication for misdemeanor possession of a controlled substance and possession of marijuana and failure to notify the department of arrests.
East Texas Medical Center EMS, Tyler, TX. January 3, 2015, assessed a $7,000.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(m)(1), 157.11(m)(4), 157.16(d)(14), and HSC §773.050(a) related to staffing an EMS ambulance vehicle with EMS personnel with expired certifications.

Elite Medical Transport of Texas, LLC DBA Medical Transport, El Paso, TX. January 5, 2015, assessed a $500.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(d)(1), 157.11(d)(4) and 157.11(j)(5) related to failing to have EMS ambulance vehicle(s) adequately equipped and supplied at all times and failing to have an environmental system capable of heating or cooling the patient compartment.

Emergency Room Mobile Services Inc., DBA Rescue Squad, Flower Mound, TX. August 10, 2014, assessed a $750.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(d)(1), 157.11(i)(2), 157.11(j)(1), and 157.11(m)(11) related to failing to have EMS ambulance vehicle(s) adequately equipped and supplied at all times and failing to assure current protocols, equipment, supply and medication lists are maintained on each vehicle.

Eva L. Rodriguez DBA Life Saver Ambulance, Leon Valley, TX. October 30, 2014, assessed a $250.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(d)(1), 157.11(i)(2), and 157.11(j)(1) related to failing to have EMS ambulance vehicle(s) adequately equipped and supplied at all times.

Exclusive Medical Transport Services LLC DBA Exclusive Ambulance Service, San Juan, TX. November 21, 2014, assessed a $3,850.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(c)(2)(D), 157.11(d)(1), 157.16(d)(14), 157.11(j)(1), 157.11(m)(1), 157.11(m)(4), and HSC §773.050(a) related to failing to have EMS ambulance vehicle(s) adequately equipped and supplied at all times, failing to display vehicle authorization in patient compartment, and staffing an EMS ambulance vehicle with EMS personnel with expired certifications.
Feltgen, James D., Coolidge, TX. November 1, 2014, reprimanded for violating EMS Rules 25 TAC §§157.36(b)(1), 157.36(b)(2), 157.36(b)(22), 157.36(b)(23), 157.36(b)(26), and 157.36(b)(30) related to conviction for driving while intoxicated, interference with emergency telephone call and resisting arrest, failing to notify the Department of an arrest, and failing to notify the Department of a change in criminal history.

Floren, Casey D., Aubrey, TX. October 1, 2014, revoked for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(14), 157.36(b)(19), 157.36(b)(23), 157.36(b)(28), 157.36(b)(29) and 157.36(b)(30) related to misappropriating and/or tampering and/or adulterating, and/or self-administering morphine from his employer and an arrest for diversion of controlled substance for personal use and not notifying the Department of the arrest.

Fuentes, Christina C., Arlington, TX. October 1, 2014, reprimanded for violating EMS Rules 25 TAC §§157.36(b)(7) and 157.36(b)(30) related to failing to follow medical director protocols by performing advanced level of care outside your scope of certification.

Garcia, Adiel, Brownsville, TX. September 12, 2014, reprimanded for violating EMS Rules 25 TAC §157.32(r)(1) related to assisting to provide an EMS paramedic education course without approval from the Department.

Garner, John M., Amarillo, TX. January 18, 2015, 18 month suspension; initial 6 months actual suspension, remaining 12 month probated suspension for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(14), 157.36(b)(19), 157.36(b)(28), and 157.36(b)(30) related to tampering with and/or misappropriating several vials/ampules of Fentanyl, Versed, and/or Ketamine belonging to employer.
Giesie, Frank D., Wharton, TX. February 10, 2015, 1 month suspension EMT-Paramedic certification and 6 month suspension EMS Instructor license related to failing to follow school policy regarding emergency procedures for medical emergency, providing a student with expired medications, and misappropriating medications from school.

Gohlke, Preston S., Grand Prairie, TX. September 24, 2014, reprimanded for violating EMS Rules 25 TAC §§157.36(b)(1), 157.36(b)(30), and HSC §773.041(b) related to staffing an emergency medical service (EMS) vehicle without holding a current Department issued EMS personnel license and/or certificate.

Gonzalez, Jr., Joe E., Fort Worth, TX. October 1, 2014, reprimanded for violating EMS Rule 25 TAC §157.36(b)(3) related to failing to properly assess a patient and failing to complete a patient care report.  

Gutierrez, Jorge L., Andrews, TX. February 27, 2015, 6 months suspension for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(19), 157.36(b)(28), 157.36(b)(29), and 157.36(b)(30) related to ingesting an illegal controlled substance: synthetic cannabis, also known as “K2”, which caused seizure like symptoms in the back of an ambulance, while attending to a patient.

Hefner, Jeremy G., Kilgore, TX. December 9, 2014, revoked for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(14), 157.36(b)(19), 157.36(b)(28), 157.36(b)(29), and 157.36(b)(30) related to on-duty misappropriation from employer Fentanyl and Versed, testing positive to Benzodiazepines, Marijuana and Opiates without physician’s prescription.

Hopkins, Erik G., League City, TX. October 1, 2014, reprimanded for violating EMS Rules 25 TAC §§ 157.36(b)(1) and 157.36(b)(30), and HSC §773.041(b) related to staffing an emergency medical service (EMS) vehicle without holding a current Department issued EMS personnel license and/or certificate.

Huntsville – Walker County EMS, Huntsville, TX. November 19, 2014, reprimanded for violating EMS Rules 25 TAC §§157.11(d)(1), 157.11(i)(3), 157.11(j)(5), and 157.11(m)(11) related to failing to have EMS ambulance vehicle(s) adequately equipped and supplied at all times, maintain and have in date all solutions and pharmaceuticals in accordance with FDA recommendations, and failing to assure current protocols, equipment, supply and medication lists are maintained on each vehicle.

Jones, Kyle B., Cleveland, TX. October 1, 2014, reprimanded for violating EMS Rules 25 TAC §§ 157.36(b)(1) and 157.36(b)(30), and HSC §773.041(b) related to staffing an emergency medical service (EMS) vehicle without holding a current Department issued EMS personnel license and/or certificate.

Kearney, Brendan P., Flower Mound, TX. October 24, 2014, reprimanded for violating EMS Rules 25 TAC §§ 157.36(b)(1), 157.36(b)(30), and HSC §773.041(b), related to staffing an emergency medical service (EMS) vehicle without holding a current Department issued EMS personnel license and/or certificate.

Kinney, Shane G., Ingleside, TX. July 23, 2014, revocation pursuant to Chapter 53 of the TOC §53.021(b) related to felony convictions and imprisonment for two counts of Arson.

Laney, Paul A., El Paso, TX. September 9, 2013, twenty-four (24) month probated suspension for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(22), 157.36(b)(26), and 157.36(b)(28) related to deferred adjudication for improper photo/visual recording arouse/gratify, and failing to notify the Department of change in criminal history.

Lara, Ricci L., Angleton, TX. March 12, 2015, 6 months suspension for violating EMS Rules 25 TAC §§157.2(1), 157.36(b)(3), 157.36(b)(7), and 157.36(b)(9) related to failing to do a complete assessment,  failing to obtain a physician’s directive and/or the patient’s signed release to not be transported to a hospital, and failing to accurately and/or completely document in the patient care report.

Long, Robert A., Anna, TX. April 16, 2015, 24 month suspension, initial 6 month actual suspension, and the remaining 18 month probated suspension for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(14), 157.36(b)(19), 157.36(b)(28), 157.36(b)(29) and 157.36(b)(30) related to misappropriating and/or self-administering fentanyl and morphine while on-duty, and testing positive to fentanyl, morphine and marijuana.

Ludden, Brian T., Houston, TX. July 21, 2014, revocation for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(19), 157.36(b)(21), 157.36(b)(22), 157.36(b)(23), 157.36(b)(26), 157.36(b)(27), 157.36(b)(28), and 157.36(b)(30) related to an arrest for possession of controlled substance and driving while intoxicated and failing to notify the Department of arrest, conviction for misdemeanor possession of a controlled substance and driving while intoxicated, failure to notify the department of a change in criminal history, and failure to respond to the Departments request for information.   

MacDonald, Daniel C., Sundown, TX. May 10, 2015, revoked for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(23), 157.36(b)(28), 157.36(b)(29), and 157.36(b)(30) related to an arrest for driving while intoxicated, failing to notify the Department of an arrest, operating an EMS ambulance and/or transported a patient while intoxicated, conviction for driving while intoxicated, and possession of a marijuana pipe. 

May, Terry M., Conroe, TX. November 17, 2014, revoked for violating EMS Rules 25 TAC §§ 157.36(b)(1), 157.36(b)(2), 157.36(b)(14),157.36(b)(19), 157.36(b)(28), 157.36(b)(29), and 157.36(b)(30) related to diverting and/or tampering with Morphine and Fentanyl and/or self-administering Morphine and Fentanyl.

McConnell, Leslie A., Fort Worth, TX. June 11, 2014, 24 month probated suspension for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(28), 157.36(b)(29), and 157.36(b)(30) related to failing a urinalysis drug screen test for the presence of amphetamine and methamphetamine.

McGehee, Shelly R., Whitney, TX. October 1, 2014, reprimanded for violating EMS Rules 25 TAC §§157.36(b)(1), 157.36(b)(2), 157.36(b)(18), 157.36(b)(23), and 157.36(b)(26) related to committing fraud to gain benefits form social service programs, receiving deferred adjudication for securing execution of document by fraud, and failing to notify the Department of a change in criminal history.

Midkiff, Jennifer D., Kirbyville, TX. February 10, 2015, 18 month probated suspension for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(18), and 157.36(b)(28) related to committing insurance fraud.

Miller, Glenn E., Flynn, TX. February 27, 2015, revoked for violating EMS Rules HSC 773.0614(c)(1) related to receiving deferred adjudication for having committed the second degree felony criminal offense of sexual assault.

New Star EMS LLC DBA New Star, Houston, TX. April 10, 2015, reprimanded for violating EMS Rules 25 TAC §§157.11(d)(1), 157.11(i)(2), and 157.11(j)(1) related to related to failing to have EMS ambulance vehicle(s) adequately equipped and supplied at all times, and failing to assure critical patient care equipment has spare batteries or an alternative power source.

North Star Ambulance Service LLC, Del Rio, TX. November 1, 2014, 3 year probated suspension for violating EMS Rules 25 TAC §§157.11(d)(1), 157.11(j)(1), 157.11(m)(11), 157.11(m)(15), 157.11(m)(19)(D), 157.11(m)(19)(E), 157.11(m)(20), 157.16(d)(5), and 157.16(e)(5) related to submission of provider license application with falsified medical director signature and initials, failing to notify the department of a change in medical director, and the department was unable to conduct an unannounced inspection as provider failed to notify of new address.

Nueces County ESD 4, Corpus Christi, TX. September 24, 2014, assessed a $500.00 administrative penalty for violating EMS Rules 25 TAC §§157.11(d)(1), 157.11(i)(2), and 157.11(j)(5) related to failing to have EMS ambulance vehicle(s) adequately equipped and supplied at all times and failing to assure critical patient care equipment has spare batteries or an alternative power source.

Oladapo, Bolaji T., Richmond, TX. February 27, 2015, revoked for violating EMS Rules 25 TAC §§157.36(b)(3) and 157.36(b)(21) related to failing to make an accurate and/or complete PCR, and failing to respond to Department request for information.
Olson, Michael R., Fort Worth, TX. May 14, 2015, revoked for violating EMS Rules 25 TAC §§157.36(b)(2), 157.36(b)(14), 157.36(b)(23), 157.36(b)(28),  and 157.36(b)(30) related to tampering and misappropriating several vials/ampules o Propofol from your employer, arrests for driving while intoxicated, and failing to notify the Department of arrests.

Overman, Grady D., Plano, TX. May 3, 2015, revoked pursuant to Chapter 53 of the TOC §53.021(b) related to felony conviction and imprisonment for two counts of receipt of child pornography.

Phillips, Nathan W., Orange, TX. February 13, 2014, 24 month probated suspension for violating EMS Rules 25 TAC §§157.36(b)(1), 157.36(b)(2), 157.36(b)(22), 157.36(b)(23), and 157.36(b)(26) related to a conviction for indecent exposure, failure to notify the Department of a change in criminal history, and failing to notify the Department of an arrest.

Whiteley, Gregory S., Allen, TX. October 7, 2014, reprimanded for violating EMS Rules 25 TAC §§ 157.36(b)(2), 157.36(b)(19), 157.36(b)(23), 157.36(b)(26), 157.36(b)(28), and 157.36(b)(30) related to receiving deferred adjudication for seven counts of second degree felony criminal offense of manufacture/deliver controlled substance, and an arrest for seven counts of manufacture/deliver controlled substance and you failed to notify the Department of the arrest.
