DRAFT 2 RULE REVISIONS

The Agency has available for comment Draft 2 revisions to 25 Texas Administrative Code (TAC) §289.201 concerning general provisions for radioactive material.  Revisions to §289.201 include, but are not limited to, the following:

  • Draft 1 changes.

  • There are no additional changes since Draft 1.

The comment deadline for 25 TAC §289.201 is February 27, 2015.

DRAFT 2 RULE REVISIONS

The Agency has available for comment Draft 2 revisions to 25 Texas Administrative Code §289.202 concerning standards for protection against radiation from radioactive materials.  As the result of comments received regarding Draft 1, revisions to §289.202 include, but are not limited to, the following:

  • Draft 1 changes.

  • To maintain rules that are compatible with the NRC, Title 10, CFR, §20.2011, the words "to ensure against recurrence" are added relating to corrective action taken for exceeding the dose restraint limit.

  • Language is added to clarify the required information on calibration records.

  • To maintain rules that are compatible with the NRC, Title 10, CFR, §20.1403, a new paragraph heading and additional language are added for criteria for license termination under restricted conditions.

  • Language is added to the footnotes for the acceptable surface contamination table as it was previously omitted and other language is revised for clarification.

The comment deadline for 25 TAC §289.202 is February 27, 2015.

DRAFT 2 RULE REVISIONS

The Agency has available for comment Draft 2 revisions to 25 Texas Administrative Code §289.251 concerning exemptions, general licenses, and general license acknowledgements. As the result of comments received regarding Draft 1, revisions to §289.251 include, but are not limited to, the following:

  • Draft 1 changes.

  • To maintain rules that are compatible with the NRC, Title 10, CFR, §31.12, the words, "the NRC, any agreement state, or any licensing state" are added relating to general license requirements for certain items and self-luminous products containing radium-226.

  • The term "Radiation Safety Licensing Branch" is replaced with the word "agency" to correctly reflect the responsible authority.

The comment deadline for 25 TAC §289.251 is February 27, 2015.

The Agency has available for comment Draft 2 revisions to 25 Texas Administrative Code (TAC) §289.252 concerning licensing of radioactive material.  As the result of comments received regarding Draft 1, revisions to §289.252 include, but are not limited to, the following:

  • Draft 1 changes.

  • To maintain rules that are compatible with the NRC, Title 10, CFR, §§32.210 and 32.211, the words, "certificate of" are added to the sealed source or device evaluation subsection.

  • The term "Radiation Safety Licensing Branch" is replaced with the word "agency" to correctly reflect the responsible authority.

  • Language is revised for clarification for:

      • holding radioactive waste, sources or devices that are not in use for longer than 24 months; and

      • expiration and termination of licenses and decommissioning of sites.

  • To correct a rule reference, language is revised in the transfer of materials subsection.

  • Language is added to the record retention paragraph to ensure the destruction of records relating to the physical protection requirements of Category 1 and Category 2 quantities of radioactive material.

The comment deadline for 25 TAC §289.252 is February 27, 2015.

The Agency has available for comment Draft 2 revisions to 25 Texas Administrative Code (TAC) §289.257 concerning packaging and transportation of radioactive material.  As the result of comments received regarding Draft 1, revisions to §289.257 include, but are not limited to, the following:

  • Draft 1 changes.

  • The term "Radiation Safety Licensing Branch" is replaced with the word "agency" to correctly reflect the responsible authority.

  • Language is revised for clarification for transporter registration renewal and for submission by shippers of a list of approved shipping containers.

  • Language is deleted to remove reference to "the board" as it is not defined in rule.

The comment deadline for 25 TAC §289.257 is February 27, 2015.
